Understanding Our Terms and Conditions
At The Wee Red Car, we believe in transparent and fair practices. Our terms and conditions protect both our pupils and our instructor, so everyone knows their rights and responsibilities. Please read them before your first lesson, then confirm you accept them using the form at the bottom of this page. You'll receive an email confirming your acceptance, with a copy of the terms for your records.
Your Trainer
Your trainer is bound by the DVSA Driving Instructor Code of Practice, which sets out the standards expected of all Approved Driving Instructors. You can read it on GOV.UK. The Trainer will at all times, to the best of their ability, endeavour to train you in line with the DVSA National Standard for Driver and Rider Training, at a level that suits you and with road safety at the heart of every lesson. The contract for Instructor Training is solely between you and Your Trainer. You and Your Trainer are responsible for agreeing all matters relating to the timing, location and duration of individual training sessions.
You must notify Your Trainer of any matters which affect your ability or entitlement to having instructor training, for example, but not limited to, any lack, or loss of a valid driving licence, any illness or drugs (prescribed or not) which may affect ability, or any offences driving or criminal. Your Trainer will check your driving licence and your ability to read a number plate at the required distance at your first lesson, and from time to time during your training. Your Trainer will be courteous, polite and punctual. Your Trainer’s car will be well maintained, clean and tidy. The Trainer’s car is fitted with dual controls as part of their standard equipment. It will be fully insured for instructor training and for use as a test car if required. Your Trainer’s ADI badge will be displayed in the windscreen during every paid lesson. The Trainer will not smoke in the car, nor will they use your training time for any other form of business, personal or otherwise during the lesson duration. Your Trainer will not use a mobile phone or hand-held device while instructing, including for hands-free calls. If a tablet is used to record your progress or show you a diagram or video, the car will first be parked safely with the engine switched off.
Your Trainer will keep a record of the lessons you have had and the hours completed, and will regularly explain your progress and what further training you need to reach test standard.
Professional Boundaries & Safeguarding
Your Trainer will treat you with respect at all times and will keep the relationship professional. Contact outside lessons will only be about your training and will be through the business phone, email or messaging account – not personal social media. Physical contact will only happen where it is needed for safety, or where it has been explained and agreed with you first.
Payments & Price Changes
Payments made on a session-by-session basis are to be paid for regular customers 48 hours in advance electronically either by bank transfer or by secure card payment link. Current lesson prices and lengths are: 60-minute lesson £47.50; 90-minute lesson £71.25; 120-minute lesson £95; block of 10 hours £450. Use of the car for your driving test will be charged at the duration for a warmup and test, normally 2 hours. Travel fee: pupils outside Your Trainer’s normal operating area (mostly those who need specialist equipment or training) are charged a travel fee for each session, whatever the session length. The fee is the distance in miles, one way by the usual driving route, from Your Trainer’s business address to the agreed pickup point, multiplied by £2.25, minus £22.50. If this comes to £0 or less, no travel fee is charged. For example, a pickup point 30 miles away: 30 × £2.25 = £67.50, minus £22.50 = a travel fee of £45.00 per session. Any travel fee will be confirmed to you in writing before your first lesson. The price of training which has not been pre-paid as part of a block booking may be changed at any time. You will always receive prior notice of such changes. All money paid in advance is recorded, and you can ask for a statement of payments made and lessons taken at any time.
Cancellations
48 hours notice is normally required to cancel or postpone a training session, if this is not possible and the session cannot be re-arranged to a mutually acceptable time within 7 days of the cancelled training, at the total discretion of The Trainer, the full training fee for the period in question may be lost or charged. If Your Trainer needs to cancel a lesson, they will give you as much notice as possible and offer another time at no extra cost. If a lesson you have paid for cannot be rearranged, it will be refunded in full.
Refunds
If You have arranged and paid for a Block of training and wish to cancel the amount of repayment will depend on: i) how you have paid for the training; and ii) whether You have commenced any or all parts of the training. If You have undertaken more training than You have paid for at the point of cancellation You must pay Your Trainer any outstanding sums owed within 14 days. If we lose contact with you for more than 28 days, Your Trainer will write to you at your last known email or address. Any unused balance will be held for 12 months from your last lesson and can be used for lessons, or refunded on request, during that time. Where a refund is owed, it will be made in the same payment method you used, minus an administration fee of 10% to cover reasonable costs, unless expressly agreed otherwise.
Tests
You must book, change or cancel your own driving test on GOV.UK. Under DVSA rules, Your Trainer cannot book, change, swap or cancel a car driving test for you, but will tell you the dates and times they are available to take you. The Trainer will not be liable for any loss of test fees. No responsibility can be taken for tests cancelled by the DVSA due to adverse weather or other reason, nor can Your Trainer take responsibility for you losing any required documentation or failing an eyesight test. Your Trainer will take responsibility for the loss of test fee if it is cancelled due to the condition of the Trainer’s vehicle.
Before you book, Your Trainer will talk to you about whether you are ready and may advise you to choose a later date. If Your Trainer believes you will not be safe to take the test in their car, they will tell you early enough for you to avoid losing your test fee. You can choose whether Your Trainer sits in on your test, and they will go through the examiner’s feedback with you afterwards.
Your Right To Cancel
If you agree to these terms by email, phone, message or our online form, you have 14 days from the date you accept to change your mind and receive a full refund of anything you have paid. If you ask for lessons to start within those 14 days and then cancel, you will only pay for lessons already taken. After the 14 days, the Cancellations and Refunds sections above apply.
Accepting These Terms
You will receive these terms in writing, by email or on our website, before your first lesson. Please confirm you accept them using the Terms Acceptance form on our website. When your form is received, you will be sent an email confirming your acceptance, with a copy of these terms for your records. If the form has not been completed, you will be asked to confirm at your first lesson and this will be noted in your lesson record. A record of your acceptance is kept with your lesson records.
Delays and Postponements by Trainer
Any student may be refused a training session if The Trainer has reason to believe that the student is under the influence of drink or drugs and the training session will be charged for at the full amount. Your Trainer will endeavour to attend your training session on time, but if delayed the time lost will be made up at the end of the session or if not possible or convenient added to a future session. If a session is postponed or cancelled due to traffic congestion or vehicle breakdown, The Trainer will endeavour to rebook the session within a 7-day period on a mutually agreed time and date.
Photos, Videos and Reviews
Your Trainer will never share photos or personal details of you, including pass photos, without your explicit written consent. You can give this consent on the Terms Acceptance form, and withdraw it at any time.
Your Personal Information
Your Trainer will keep your personal details, lesson records and the record of your acceptance of these terms safely, in line with data protection law. Your information will not be shared with anyone else unless you agree or the law requires it. Full details are in our Privacy Policy at www.theweeredcar.co.uk/privacy-policy.
Complaints
Complaints should be made in the first instance to The Trainer, who will deal with them promptly and keep a record of the complaint and how it was resolved. If you are not able to resolve the matter in this manner, as a final step the complaint can be put in writing to Iain Gray Driving Instructor, 52 Ladeside Gardens, Inverurie AB51 3XA. Email: iain.gray@theweeredcar.co.uk. Please raise any complaint as soon as possible, ideally within 21 days, so it can be looked into while the details are fresh. Failing agreement or settlement of a dispute, you can contact the DVSA ADI Registrar at instructorconduct@dvsa.gov.uk about your Trainer’s professional conduct, or Citizens Advice for guidance about the business service you have received. If you ever experience inappropriate behaviour from any driving instructor, you can report it to DVSA.
